Landed Property: Two Persons Arraigned Over Alleged Forceful Entry, Malicious Damage

Police in Osun State has arraigned two persons, Adedayo Rasaki, 38 and Adeboye Adedayo, 43, before an Ile-Ife Magistrates’ Court over alleged forceful entry and malicious damage.

The Prosecutor, Mr Saheed Anifowose, told the court that the defendants committed the offence sometimes in February, at NTA road, Ile-Ife.

Anifowose said the defendants conspired to commit felony to wit: forceful entry and malicious damage.

He said the defendants unlawfully destroyed building fence valued N400,000, belonging to Prophetess Omotayo Serifat and others.

According to him, the defendants forcibly entered into the land of Prophetess Omotayo Serifat, contravening Sections: 81,451 and 517 of the Criminal Code, Laws of Osun, 2002.

The defendants, however, pleaded not guilty to three-count charge of: conspiracy, forcible entry and malicious damage.

Counsel to the defendants, Mr Micheal Koyejo, applied for the bail of his clients in most liberal terms, with the promise that they would not jump bail, rather provide reliable sureties.

Magistrate Kikelomo Adebayo granted defendants bail in the sum of N200,000 with one surety in like sum each. 

Adebayo, directed that the sureties must swear to affidavit of means, reside within the court jurisdiction, and addresses to be verified by the prosecutor.

She stated further that the sureties must be their blood relations, produce three years tax clearance certificate, with means of identification as well as produce three recent passport photographs each. 

Meanwhile, the defendants are to be remanded in Ile-Ife Nigerian Correctional Service pending the perfection of their bail conditions.

The case was adjourned until August 8, for hearing.
